Which marriage is not allowed in Pakistan? This is the question asked by many people. It’s not all the marriages that are considered legal in Pakistan. The law restricts some marriages and bars the registration of marriage certificates in Pakistan for those marriages. Which marriage is not allowed in Pakistan is given below.
SAME-GENDER MARRIAGE:
Same-gender marriage is prohibited in Pakistan. The law of the country does not allow same-sex marriage. It is a crime in Pakistan for anyone to do any such marriage.
CHILD MARRIAGE:
Child marriage is restrained according to the Child Marriage Restraint Act in Pakistan. The age for the purpose of marriage is eighteen years in the provinces of Sindh, KPK, and Baluchistan, whereas the age of marriage for females is 16 years in the Punjab province. A restraint order can be obtained from the court on the complaint of child marriage, but once the marriage is done, it does not invalidate the marriage.
CONSENT WITH FORCE:
The law of the country does not allow any marriage in which the consent of the male or the female is taken by force. If any such marriage happens in which the consent of the male or the female was taken by force, such marriage will be null and void even if the marriage was registered. The nikahnama registration in Pakistan, in which the consent was taken by force, can be cancelled.
NON-MUSLIM:
A Muslim male can marry a non-Muslim from the religion of the books. If a male marries any non-Muslim female other than those of the religion of the books, such a marriage will be null and void. A Muslim female can only marry a Muslim male. She cannot marry a non-Muslim.
MARRIAGE WITHOUT DIVORCE:
A married female can only marry someone else after a divorce in Pakistan. If she marries someone else while already being married, it will be a crime. If she wants to marry someone else, she has to first get a divorce. Once she is issued the divorce certificate in Pakistan, only then can she marry someone else. She will first have to go through the khula procedure in Pakistan to get the divorce certificate.
SECOND MARRIAGE WITHOUT PERMISSION:
A married male can only do a second marriage if he has the permission from his first wife. If he does a second marriage without the permission of the first wife, then he can go to jail if the first wife sues him. For permission from the first wife, he needs to take the wife to the union council along with two witnesses. The council, after taking the written application and affidavit, will issue him the permission certificate.
MARRIAGE WITHIN PROHIBITED DEGREE OF RELATIONSHIP:
Some of the relationships are barred in the country from being married. A person cannot marry some of the close relatives, like father, mother, brother, sister, father-in-law, mother-in-law, grandson, granddaughter, etc. These relationships are barred from being married. If someone does a marriage within prohibited degrees, he or she can go to jail.
