In order to hire a lawyer, you have to give him a power of attorney for court cases in Pakistan. This power of attorney for court cases in Pakistan is also called a wakalatnama. Ø Name of the person signing this document.
Ø Nature of case (civil or criminal)
Ø Offense in case this document is required for criminal cases
Ø Type of case for which this document is signed. For example, court marriage in Pakistan, divorce in Pakistan, the Khula procedure in Pakistan, property cases, etc.
IN CASE YOU ARE ABROAD? In case you are not in Pakistan and you want to hire a lawyer for the court case, then you have two options.
Ø The first option is that you can give power of attorney to your lawyer.
Ø You can give the power of attorney to anyone, and then the person to whom the power of attorney is given will hire a lawyer through a wakaltnama in Pakistan.
Court Cases from Abroad:
If you are sending a special power of attorney for the court cases from abroad, then you have to first get this document attested from the Pakistani embassy or consulate, and then post the original power of attorney to the receiver. Once the receiver receives the original power of attorney, he will take this document to the Ministry of Foreign Affairs in Pakistan and get it attested there. Once this power of attorney is attested by MOFA, then the receiver is authorized to represent the sender in court through a lawyer.
Even if you send the power of attorney directly in the name of the lawyer, the lawyer also has to get it attested from the Ministry of Foreign Affairs, then he will be authorized to represent the client in the court. The contents of the power of attorney authorize the attorney to use the power he can use on behalf of the client.
