Talaq During Pregnancy in Islam:
Talaq during pregnancy in Islam is valid, but it does not become operational until the wife gives birth to the child. When the male gives the divorce to the wife during her pregnancy, the divorce is done, but from the time and date of divorce, her iddat period starts. The iddat period of the wife after the talaq during pregnancy in Islam is not 90 days. The iddat period of the wife during pregnancy extends till she finally gives birth to a child. In normal circumstances, the iddat period of the wife after the divorce is 90 days, but when she is given talaq during pregnancy in Islam, the iddat period extends till the delivery of the child. Islam has given this grace period so that people can save their families. Talaq in Pakistan and other countries gives the right to divorce, but is subject to the law and Islam.
Iddat In Talaq During Pregnancy:
Ø IN CASE OF CHILD’S BIRTH:
When the wife is given a divorce when she is pregnant, the iddat period extends till the delivery of the child. After the birth of the child, the iddat period expired. During the iddat period, the male can take his wife back, and he only has to say to the wife that he takes her back as a wife. No formal sexual consummation is required if the husband wants to take the wife back during the iddat period. If the divorce is not taken back, the wife can obtain the divorce certificate in Pakistan as proof that she is now divorced.
Ø IN CASE OF MISCARRIAGE:
In case the child is not fully formed and the child is not delivered, the iddat period will come to an end when the miscarriage of the child happens. The iddat period will extend only till the date when the miscarriage happened. Before the miscarriage, the husband can take his wife back. He only has to say the words that he takes his divorce back and retains her as his wife. Not even sexual intercourse is required between the husband and wife in this condition to take the wife back.
The iddat period is the grace period given by the religion of Islam so that the husband and wife can rejoin after the divorce. In case the iddat period has expired, and after the expiry of the iddat period, both the husband and the wife want to rejoin as husband and wife, then both the male and female have to remarry. This remarriage will be with the new haq mehar amount.
