REMAND IN PAKISTAN:
Remand in Pakistan means to hand over the custody of the accused. The accused can be handed over to the police or to the jail authorities. It is up to the court to decide whether the accused should be handed over to the police or jail authorities. When, in a criminal complaint, the accused is arrested by the police, the police have to present the accused before a judge. The judge will see the case and the circumstances and decide if the accused should be taken into the custody of the police or the jail authorities. The accused has the right to be presented through a lawyer in Pakistan. When the accused is placed in the custody of the police, it is called physical remand in Pakistan. When the accused is handed over to the jail authorities, it is called judicial remand in Pakistan.
Types of remand:
There are generally two types of remand in Pakistan.
- Physical remand
- Judicial remand
PHYSICAL REMAND:
The physical remand in Pakistan means to hand over the custody of the accused to the police. The police may require the custody of the accused for the purpose of an investigation. When the police think that any accused is required for the purpose of investigation, they can request the court for physical remand in Pakistan. Generally, the police may request a remand from the court when something is required to be recovered from the accused. For example, in the case of murder, the accused may be required by the police to recover the murder weapon. If something is not required to be recovered from the accused, the lawyer of the accused can request the court cancel the request of the police for physical remand of the accused. It is to be noted that even if the accused is given on remand to the police, the police cannot torture the accused for any reason. This is the law that says the accused cannot be tortured, but we all know that the police in Pakistan do work by the book. The lawyers in Pakistan are the protectors of the accused. If the accused is tortured by the police, the lawyer can file an application against the police as well. The police can also be brought to justice if they misuse their powers.
