OVERSEAS KHULA IN PAKISTAN:
The Pakistani law allows the overseas khula in Pakistan. If a wife is not in Pakistan and is living abroad, she has the right to file the case of khula in the family court, and for that she doesn’t even have to come to Pakistan. The law says that you cannot stop a female from obtaining the khula only for the reason that she is not in the country. The law also says that you cannot force a female to come to Pakistan only for the reason that she needs khula. If a wife is living abroad and she needs an overseas khula in Pakistan, all she needs to do is to hire the services of a lawyer and send him a power of attorney so that he can file the case on her behalf without her presence in Pakistan.
Khula is a procedure of divorce in Pakistan initiated by the female. A female cannot be forced to live in a relationship that she does not want. A male has the right to divorce his wife, and the wife also has the right to obtain the khula. The overseas khula in Pakistan can be filed through a lawyer in the family court. The law gives the right to the female to obtain the khula from any part of the country. To file the case in Pakistan, the following conditions should be fulfilled.

Ø A Pakistani female citizen can file a case in Pakistan.
Ø A female who is not a citizen of Pakistan but is married to a Pakistani citizen can file the case in Pakistan.
Ø A foreign female whose marriage is registered in Pakistan can file a case of dissolution of marriage in Pakistan.
Ø A foreign female whose husband is residing in Pakistan can file a case in Pakistan.
PROCEDURE:
 Below is the procedure to obtain the overseas khula in Pakistan.
Ø Contact a lawyer
Ø Give him the details of your case.
Ø Provide him with all the necessary documents.
Ø The lawyer will email you the power of attorney.
Ø Take a print of the power of attorney and get it attested from the Pakistani embassy or consulate of the country where you are residing.
Ø Post the original power of attorney to the lawyer
Ø The lawyer will get the attorney attested from the Ministry of Foreign Affairs in Pakistan.
Ø The lawyer will file your case and get you the khula decree.
Right:
The female not only has the right to obtain an overseas khula in Pakistan, but after the khula decree from the court and after the expiry of the iddat period, the female can also obtain the divorce certificate in Pakistan without her presence through her lawyer. The decree of khula is not sufficient for a wife to marry someone else. After the khula decree, she will also need a divorce certificate as proof of talaq in Pakistan.
