Can Khula be reversed in Islam?
This is a question asked of us many times. Sometimes, when a female takes khula from the court, she thinks that she made a mistake, and she wants to go back to her previous husband. Khula can be reversed in Islam, but you need to understand when and under what conditions it can be.
Final orders or Certificate:
In some countries, the court orders on khula or divorce are final, and after that, no procedure or process is pending. When no further process or procedure is pending and the court orders are final, then in this case, if the wife wants to rejoin the previous husband, the wife has the right in Islam to marry the previous husband again. She can marry her previous husband without any halala or intervening marriage. All she needs to do is remarry her previous husband with a new haq mehar amount.
Where Court Order is Not Final:
There are some countries where the court orders are not final, and after the court orders, you also have to follow some additional steps to confirm the divorce. For example, if a female files the case of khula in Pakistan, the court orders are considered the first divorce. Even after the court orders, she has to submit the court orders to the arbitration council. The arbitration council follows the procedure of 90 days and tries to have reconciliation between the spouses. In case the reconciliation fails, only she is issued a divorce certificate in Pakistan. After the divorce certificate, it is considered that she is now divorced. Prior to the divorce certificate, even if she has the court orders of khula, she is still legally the wife. If the husband and the wife want to rejoin, they can. They only need to have the consummation of marriage prior to the divorce certificate in order to reverse the khula.
During Iddat:
For your question of whether khula can be reversed in Islam, the answer is yes, it can be reversed during the iddat period of the wife. After the divorce or khula from the wife, there is still a grace period of 90 days, which is called the iddat period. If the husband and the wife consummate the marriage during this grace period, then the khula is reversed.
After Iddat:
If there was no consummation between the husband and the wife during the iddat period, and after the iddat, the husband and the wife still want to live as husband and wife, they can. They have remarried each other with a new dowry amount in order to live as husband and wife.
