Absconder in Pakistan:
An Absconder in Pakistan is a person against whom any criminal case is built up but he is willfully avoiding his arrest or services of summons, notices, or warrant. When a case is made up against a person he is required either by the law enforcement agencies or the court. As per the law, such a person is required to come before law enforcement agencies or the court so that his guilt may be determined. Such a person has the right to prove him innocent. When a person willfully avoids himself to be present before the court or the police then an adverse inference can be drawn against him. When such a person is avoiding the court proceedings then he can also be declared as a proclaimed offender in Pakistan by the court. A person when is required then it is his duty to come forward and prove his innocence else he will be declared an absconder in Pakistan. The absconder has the right to prove his innocence. For example, in rape cases, the accused can show the documents that he has done court marriage in Pakistan.
- ABSCONDER BY POLICE: When a criminal case is made up against a person the police try to arrest the accused. When the accused is trying to hide himself so that he can avoid the proceedings then the police declare him a police absconder. Nowadays when a person is declared an absconder the police put his ID card number in the police system so that whenever he uses his ID card he can be traced. When a person is arrested his name with ID card number is also put in the system called CRO which shows that the person is accused and arrested. When a person is arrested by the police then as a last resort they declare him as an absconder in Pakistan and put his name in the system of CRO. When a person uses his ID anywhere in Pakistan it helps the police to arrest that person. The accused has the legal right to prove his innocence. For example in the case of infidelity, the female accused can show that she has taken khula in Pakistan from her husband.
- ABSCONDER BY COURT: When a person is arrested and his challan is submitted in the court he is required to attend the court proceedings. If the court has granted him bail then it is the responsibility of the accused to attend the court hearings in the court. To make sure he attends the court proceedings the court issues him the summons and the warrants. If he avoids the services of summons and warrants then the court may declare him a proclaimed offender in Pakistan. Proclaimed offender in Pakistan:
A person can be declared a proclaimed offender in Pakistan by the court. Section 87 of CrPC gives the court the authority to do so.
CONSEQUENCES:
When a person is declared as an absconder in Pakistan his bail can be canceled or his property or other assets can be attached.
PUNISHMENT:
An absconder can be punished with imprisonment from 6 months to 5 years.
