Abduction in Pakistan:
Abduction in Pakistan is a crime just like in other countries; it is considered a crime. There are not many abduction cases in Pakistan. As per the definition, abduction under PPC is to induce any person to go from one place to another by the use of force or by deceitful means. There is a difference between abduction and kidnapping under PPC. The punishment for abduction in Pakistan is provided in the Pakistan Penal Code. There can be different ulterior motives to abduct someone. A female can be abducted to conduct court marriage in Pakistan or for sex purposes. A person can be abducted for murder, hurt, slavery, etc.
- A wife abducts the husband to sign him the divorce paper so that she can get her divorce certificate in Pakistan and has committed the offense of abduction.
- A male induces a female to conduct an online marriage in Pakistan and has committed the offense of abduction.
- A wife, along with others, forcefully abducts B’s husband to sign the documents of divorce in Pakistan so that she doesn’t have to file the case of Khula in Pakistan and has committed the offense.
There is a difference between abduction and kidnapping under the Pakistan Penal Code of the country. The punishment for abduction in Pakistan varies as to the purpose of the offense. The difference between abduction and kidnapping in Pakistan is as follows.
AGE:
The provisions of kidnapping can be attributed to age, but in abduction, the age is not mentioned. A person can be said to abduct the other irrespective of the age of the victim.
Guardian:
Guardianship is irrelevant in the case of abduction. A child without a guardian can be abducted. But when a child with a guardian is taken away, it is called kidnapping.
Minor:
In abduction, the minority is irrelevant. A person can kidnap someone if the age of the male is below 14 or the age of the girl is below 16; however, no such age limits are provided in the sections for abduction in Pakistan.
Types:
Kidnapping is of two types. First is the kidnapping from a guardian and the other is kidnapping from Pakistan but there is no such type in the case of abduction.
Out of Pakistan:
When a person is taken out of the territorial jurisdiction of the country, it is called kidnapping, but territorial jurisdiction is immaterial.
Intention:
In kidnapping, the intent of the offender is irrelevant, but the intention of the offender is relevant in the case of abduction.
Continuity:
Kidnapping from the guardian is not a continuing offense. Once the minor is removed, the offense is completed, but abduction is a continuing offense. Whenever the person is removed from one place to another, it is another offense. For example, a person abducted is taken from Lahore to Multan and then taken from Multan to Karachi, committing two offenses, and two FIRs will be separately chalked against the offender.
Force:
A person should be abducted by using force or deceitful means of abduction, but a person can be taken away from Pakistan without these means of kidnapping.
PUNISHMENT OF ABDUCTION IN PAKISTAN UNDER PPC:
The punishment for abduction in Pakistan varies from seven to fourteen years depending on the purpose or intention for which the victim was abducted.
