NIKAH DURING PERIODS:
Nikah during periods in Islam and Pakistan is valid. There is no restriction on doing nikah during menstruation. Nikah is a contract between a male and female for the legalization of sexual intercourse. The religion or the law does not put any restriction on doing marriage or even court marriage in Pakistan if the female is going through her menstruation process. The female cannot do anything about it. The religion has set some requirements for a male and a female to do the marriage, but there is no such requirement, either by the religion or by the law, that the female should not be in the process of her period.
LAW:
The law on nikah during periods makes it clear that there is no such requirement or restriction on the female that she should not be in the process of her period. The female gets periods as the call of nature. The female cannot control this process. The families normally schedule such time for the rukhsati when the female is not under her period, but there are still some times she gets periods in those moments. This is something that she cannot control. The law on marriage and divorce in Pakistan does not impose any restrictions. Nikah during periods is valid as per the law. However, divorce during periods is not valid.
IS NIKAH VALID DURING PERIODS?
Yes, the nikah is valid during periods both in religion and in law. Both the law and the religion permit women to get married during their periods. The law does not require any such certificate that the female is free from periods. The law may require some other certificates, like divorce or an unmarried certificate, in Pakistan, but there is no such certificate that can say that the female is free from her periods.
The nikah in Pakistan should meet the legal requirements to ascertain its validity, but the validity has nothing to do with the period of a female. If the female is going through her period, it does not affect the validity of her marriage. Someone cannot claim the marriage to be invalid only on the ground that the female was under her menstruation during the time of marriage.
