Can you get a stay order on marriage in Pakistan? Is a question that we have received? The answer is yes, you can get a stay order on marriage in Pakistan. The stay order is a restraining order from the court halting someone from performing the marriage ceremony. The marriage is the right of every person, but in order to get married, it is required that the person who is getting married be eligible according to the law to perform the marriage. To perform the marriage or a court marriage in Pakistan, there are certain requirements from the law that need to be fulfilled. Can you get a stay order on marriage in Pakistan? Is a question of law? The law tells us that you can get a stay order if the below requirements are fulfilled.

  • CHILD MARRIAGE: To get married, you should be of the age when the law permits you to get married. The age of marriage is different in the different provinces of the country, but whatever the age has been set by the law, you have to fulfill the requirements. The age for the purpose of marriage or online marriage in Pakistan is 18 years for the male and female in the provinces of KPK, Balochistan, and Sindh. Only the law of the province of the Punjab says that the female can marry at the age of 16 years. If a bride or the groom is below the age required by the law of the province, then anyone can get the stay order on marriage in Pakistan. Through a stay order, you can halt the process of nikah in Pakistan, but if they have already gotten married, then this stay order or the court proceedings will not invalidate the marriage.

 

  • SECOND MARRIAGE: If a husband wants to get a second wife, then it is permitted by the law, but at the same time, the law says that you have to get permission from the first wife. If the first wife does not give permission, then a male cannot get married for the second time. If the husband is planning to get married for the second time without permission from the first wife, then the first wife can obtain the stay order from the family court. If the husband has gotten married without permission from the first wife, then the husband will go to jail, but it will not invalidate the marriage. To finish the second marriage, he has to get the divorce certificate in Pakistan.

Through the stay order, the person will be bound to conduct the marriage. This stay order can also be obtained against the parents of the bride or the groom in the case of the child marriage. Everyone is bound to obey the stay order by the court. If anyone disobeys the stay order from the court, then he may go to jail for up to six months.
